These Terms of Use shall become effective as of August 1, 2022.

Please read this Agreement carefully before you consent and keep a copy for your records. You agree to be legally bound by all terms and conditions contained in this Agreement, which are in addition to the terms and conditions in our other agreements with you.


Consent to do business electronically

By completing an application on SMBB LLC. d/b/a Ubiks (“Ubiks”) Ubiks’s website, you specifically agree to receive, obtain, and/or submit any and all information electronically. These documents and information will be collectively known as “Electronic Communications.” You agree that your electronic signature, electronic symbol or process attached to making any transaction regarding any agreement, acknowledgment, consent terms, disclosures or conditions is the legal equivalent of your manual/handwritten signature (hereafter referred to as “E-Signature”).


Paper version of Electronic Communications

You may withdraw your consent to receive electronic documents, notices or disclosures at any time. In order to withdraw consent, you must notify Ubiks that you wish to withdraw consent and request that your future documents, notices and disclosures be provided in paper format. You acknowledge that Ubiks reserves the right to charge you a reasonable fee for the production and mailing of your paper versions of Electronic Communications. To request a paper copy of an Electronic Communication, contact us at info@ubiks.io.


Revocation of electronic delivery

To withdraw consent to conduct business electronically and receive documents, notices or disclosures electronically; or withdraw consent to sign documents electronically, please contact Ubiks at info@ubiks.io. You acknowledge that Ubiks reserves the right to restrict or terminate your access to your account with Ubiks if you withdraw your consent to receive Electronic Communications.


Hardware and software requirements

Use of the Ubiks’s services is subject to sufficient hardware, software, and operating systems. You are responsible for installation, maintenance, and configuration of your computer, browser, and software. Ubiks is not responsible for errors or failures from any malfunction of your computer, browser, or software. Ubiks is also not responsible for computer viruses or related problems associated with use of an online system. We require at a minimum, a functioning modern web browser that was released in the past two years, running an up-to-date operating system. Unsupported browsers may not receive full functionality of the product.


Controlling Agreement

This Agreement supplements other agreements that you may have with Ubiks. To the extent that this Agreement and another agreement contain conflicting provisions, the provisions in this agreement will control. All other obligations remain subject to the terms and conditions of any other agreement.
